River City actor had sex with woman without her consent, trial told

A woman has told a trial that River City actor Iain Robertson had sex with her despite her insisting she did not want to.

The 48 year-old alleged Robertson forced himself on her during a getaway with others to the Lake District in 2007.

It was said to have occurred after the 45 year-old had gone into a mood because she had been playing a game with friends.

The actor - who played Stevie O'Hara in the BBC soap - is on trial at the High Court in Glasgow where he denies seven charges involving four women between 2004 and 2020.

This includes an allegation that he raped one of the women, who gave evidence earlier in the trial.

He is not charged with raping the latest witness, who was back in court to testify for a second day.

Prosecutors have instead lodged a document detailing how they may lead evidence of Robertson allegedly having sex with this woman without her consent at accommodation in Coniston, in the Lake District, sometime in September 2007.

The court heard the 48 year-old woman did not tell anyone about any sexual incident until police came to her door in 2023.

The jury was told she "burst into tears" when officers said they wanted to speak about Robertson.

Advocate depute John Keenan KC went on to question her about the incident in 2007.

The woman - who had been in a relationship with Robertson - had travelled with him to join others for a birthday celebration for a friend.

While there, she recalled how she was part of a "silly game" where a rude word was put in to the title of a film.

Jurors heard Robertson was not involved.

During the game the woman said she became aware of the actor standing out in a corridor looking "disgusted" while mouthing that he wanted to speak to her.

She said: "It was easier to do that rather than just ignore him.

"He was angry and saying what a pathetic game. Every time this happened, I just went quiet and like 'okay'. I did not know what to say."

The woman became annoyed herself and did not return to the game.

They ended up in their bedroom where she said Robertson wanted to have sex.

She told the trial: "I said 'no'. I was very upset and wanted to go to sleep."

Despite this the witness claimed Robertson "ignored" her and was kissing her.

The woman believed she also said "stop", but that Robertson went on to have sex with her in the room while holding down one of her arms.

She told the court: "I do remember not wanting it and I do remember saying that I did not want it."

Keenan asked her: "Did you want that to happen?"

She replied: "No."

The prosecutor: "How clear were you?"

The witness replied: "I said 'no'."

She was left feeling "confused" and "just exhausted by the whole thing".

Jurors were told police came to her home in October 2023 with inquiries about Robertson.

She recalled that when officers said why they were there she "burst into tears".

The witness explained she had spent a "very long time" trying not think of her time with Robertson.

However, she did not initially report any incident in the Lake District with him.

It was only during a second meeting with police a week later that she spoke about it.

Gary Allan KC, defending Robertson, went on to ask why she had not at first "talked about him raping you".

She replied it had been an "extremely traumatic thing" and it was only after initially speaking with officers she felt it was the "time" to reveal what she claimed occurred.

Allan later put to the woman that she had at "the very least consented" or even "initiated" sexual activity that night at the Lake District.

The advocate: "I suggest to you that not once did you say 'no' or 'stop'."

The woman said: "Okay - but I did."

Jurors later heard pre-recorded testimony from the final woman Robertson allegedly offended against.

The 39 year-old knew him from River City, but met him on dating app Tinder in 2019.

She said things initially were "good" before he became "distant and erratic".

The court heard the pair spent Hogmanay 2019 together at a hut Robertson had in Carbeth, Stirlingshire.

There had been a row that night before both later went to bed.

She recalled trying to get "closer" to him, but the witness alleged he instead "just pushed me a couple of times".

The woman told the hearing that she remembered crying the next day.

The relationship ended in April 2020.

Keenan closed the Crown case following her evidence.

He also withdrew a breach of the peace charge involving the woman who made the Lake District accusation.
