Teenager on trial for murder 'did not see' fatal stabbing of boy

A teenager on trial for murdering a 16-year-old at a beach in Irvine told police he did not see the fatal stabbing happen.

The 15-year-old boy and co-accused Jay Stewart, 18, are accused of killing Kayden Moy on 17 May 2025. Another teenager, Cole Turley, 18, pleaded guilty to the murder before the trial started at the High Court in Glasgow.

Jurors were read notes from a police statement given by the 15-year-old the day after the incident, when he was initially a witness and not a suspect.

The boy stated that he was "not in a feud with Kayden" and had no knowledge of any dispute between Moy and the other teenagers.

He added that he did not know Moy would be at the beach on the day of the stabbing.

The trial previously heard that Turley, Stewart and the 15-year-old were part of the Murray Boys gang in East Kilbride in South Lanarkshire.

Moy and his friends were stated to be members of the rival Himshie gang.

The 15-year-old said he did not take any weapons to the beach and had no knowledge of whether Stewart and Turley did.

It was claimed the pair "did not show" or "present" weapons.

The boy stated that he noticed Moy with friends and believed them to be a threat to him and his friends, before an unknown person approached them to tell the trio they should run as Moy had seen them.

The boy then stated they were chased to a grassy area of the beach.

The statement went on: "Did not see Cole chase after Kayden. Did not see Cole brandish weapon. Did not see him stab him".

Teen 'heard screaming' on beach

It was claimed the boy was "walking away" at the time of the incident and he referred the officer to mobile phone footage that had been circulated at the time.

The boy stated he heard screaming and was "aware something serious had happened, unsure what".

It was claimed he did not see Moy fall or collapse, and that he walked away with Stewart while other friends scrambled away from sand dunes.

He added: "Cole came from behind and made no reference to what happened and did not say anything about stabbing Kayden."

The boy stated the trio left the scene in a taxi, and they did not talk about what had happened on the beach.

The boy also claimed the trio walked about before then going to the home of a friend of Turley's.

Jurors heard the boy was arrested and charged with murder on 4 June 2025.

'I didn't murder him'

Detective Amy Campbell told jurors Stewart was arrested, cautioned and charged on 19 May 2025.

He is claimed to have replied: "I didn't murder him. I didn't pursue at him. I did not go at him with a weapon and did not show. No way I was going to use a weapon."

In relation to a charge of an attempt to pervert the course of justice, Stewart allegedly replied: "I didn't change any of my clothes. Just no comment, no comment man."

Senior fingerprint examiner Catherine Boyle told the court Turley's fingerprint was found on a lock back knife recovered.

It was stated that Stewart's print was found on an extendable baton while the 15-year-old's print was recovered from a window frame at the property of Turley's friend Fraser Wallace.

The 19-year-old witness previously gave evidence that the trio visited him on the night of the incident and left before armed police entered his home.

The murder charge says Stewart and the 15-year-old, while acting with Turley, pursued Moy and caused him to fall to the ground before they repeatedly stabbed him to the body.

It is alleged Stewart and the other teenager had previous ill-will and malice towards him.
