Former police officer who raped sleeping woman jailed
SpindriftA former police officer who filmed himself raping a sleeping woman has been jailed for seven years.
Derek McNee preyed on his victim at a house in East Dunbartonshire in 2025.
The 43 year-old was caught after police found four incriminating videos which he had captured on his mobile phone.
McNee, who left Police Scotland in 2016, was sentenced at the High Court in Glasgow after previously admitting a charge of rape.
Judge David Young KC also ordered McNee to be monitored for 18 months after his release from prison.
He told McNee: "As you recognise, there can be no free agreement when someone is incapable to give consent."
The judge added the woman - in two victim impact statements - had described her "misery" at the hands of McNee and how she remained affected.
McNee was a police officer for seven years before running a dog grooming business in Paisley.
Police ScotlandHe also pled guilty to harassing another woman between 2021 and 2025 in Glasgow and Paisley.
She was forced to change her phone number, but McNee discovered it and contacted her almost 30 times in two days.
McNee further admitted to having a stun gun after a search of his car in August 2025.
McNee was also put on the sex offenders register and banned from contacting or approaching the victims - both for an indefinite period.
The court was told that McNee had asked the woman if he could carry out sexual acts on the woman when she was sleeping.
The court heard that she she agreed and McNee suggested filming what he was doing and the woman – who had personal issues - replied "he could if he wanted to".
McNee later sent her footage he had recorded, but she looked at it and told him to delete it.
Prosecutor Ruaraidh Ferguson told the court: "Four videos were recovered from his telephone which depict McNee performing sexual acts on the woman while she is clearly and obviously intoxicated.
"At various stages, she is asleep or unconscious."
In one clip, McNee was wearing a mask across his eyes and the woman was described as "fully unresponsive throughout".
Abusive conduct
Tony Graham KC, defending, told the court: "He has accepted his guilt - that is the best thing that can be said in mitigation on his behalf."
McNee was previously put on supervision and a curfew in 2021 for terrorising a young woman, who recalled "the devil in his eyes".
He was convicted of engaging in abusive conduct following a trial at Glasgow Sheriff Court.
He assaulted the woman, threatened to kill her and tore up her designer jacket with tweezers.
Det Insp Mairi MacDonald said McNee subjected the women to "horrific abuse" and commended them for the courage in reporting him.
"They played an instrumental role in bringing this despicable individual to justice and I hope this outcome provides them with some closure and comfort," she added.
"Police Scotland does not tolerate violence or sexual abuse in any form, and I hope this outcome gives other victims the confidence to come forward and make a report to us.
"We are here to listen and to help, and our specially trained officers will support you throughout the process, alongside our partner agencies."
